Subject Fileset required directory to exist?

Is there any reason that a FileSet breaks if it's directory does not exist?

I'm asking because our build file is starting to become very convoluted from
dealin with this issue.
Ie before specifying any Fileset its necessary to check whther the directory
exists.

It seems reasonable that a FileSet with a non-existent directory would
amount to an empty FileSet.

Anyone got an opinion?
