Given that even the current code does so, the answer is yes (and I'll
admit it's a bug).

If you use "modern" and set the source attribute, the switch will be
set, yes.  The same is true for jikes as newer versions of jikes
support the switch.

I'll look into fixing it for the next 1.5beta, but there's no
workaround for 1.4.x, that I could see.

In 1.5 you can use nested compilerargs and make them conditional on
javac1.4 as a workaround.
