I searched the developers group and found the following:

I was stupidly thinking that the xslt Ant task lived entirely in
optional.jar - so I didn't think to upgrade xalan.
I just upgraded to xalan-j_2_4_D1-bin.tar.gz - xercesImpl.jar and
xml-apis.jar are okay as they are, but I replaced xalan.jar and
*so far* I cannot reproduce the errors at all.

You are not reusing instance of a transformer here...
You are using invoking a transformation per the use of the command line and
forking a new VM for each call.
