You  must set the defaultexcludes-attribute:

              <fileset dir=".">
                       defaultexcludes="no" />

>                 <include name="**/*.java~"/>
>                 <include name="**/*.class"/>

Some files are excluded by default, read the chapter "Directory based
Tasks" of the ant manual for details..
