Subject Ant 1.4.1: apply skipemptyfilesets does not work

Hi!

I have a apply task with skipemptyfilesets set to true, but the command is
executed anyway.
Although Ant states: "Skipping fileset for directory xxx. It is empty." it
executes the task.
The complete task definiition is:
        <apply executable="sqlj" dest="${classes}"
               skipemptyfilesets="true" parallel="true" type="file"
failonerror="false"
               taskname="sqlj">
            <!-- Set the Environment Classpath -->
            <env key="classpath"
path="${classpath}:${oracle.home}/lib/translator.zip"/>
