Why not do <delete dir="${dist.dir}" /> ?  Thats the syntax intended to
replace the current <deltree> functionality.  The error you are getting
there is coming from the <fileset>, not <delete>.  Currently <fileset>
requires the dir to exist.

ant.jar 1.2 from today, on Linux.
Here it stops with error for

    <delete>
      <fileset dir="${dist.dir}" includes="**"/>
    </delete>
