This is not true...
Using ant-1.6.2 JDK1.5 and putting junit + ant-junit.jar outside of ANT_HOME/lib 
I get the same error as described above. (Windows XP SP 2, x86, JDK1.5, Ant 1.6.2)
My Task is as follows:

<path id="junitreport.path">
  <path refid="libpath" />
  <!-- this includes everything in ANT_HOME/lib -->
  <fileset dir="${ant.home}/lib" id="report.ant.fileset">
    <include name="*.jar" />
  </fileset>
</path>
<taskdef name="junitrepor classpathref="junitreport.path"
  classname="org.apache.tools.ant.taskdefs.optional.junit.XMLResultAggregator" 
        
  onerror="fail" />

<junitreport todir="${test.reports}">
  <fileset dir="${test.reports}">
    <include name="TEST-*.xml" />
  </fileset>
  <report format="frames" todir="${test.reports}/html" />
</junitreport>

Using the above mentioned workaround the task works perfectly.
