It should be checked in whatever is the equivalent of the execute() of tasks 
for PatternSets or whatever. Looking at the code you modfied, instead I guess 
you should thow a BuildException if name is null.

  if (name == null) {
    throw new BuildException("Mandatory attribute 'name' is missing");
  }
  ....

not sure if this is the best location to do it. Haven't look at all the code.
