move task deletes source directory

i'm trying to move xml files from one directory to another without deleting the 
source directory:

<move todir="${out}">
  <fileset dir="${in}">
    <include name="*.xml"/>
  </fileset>
</move>

but every combination of commands i've tried so far results in deleting the 
source directory after moving the files.

is this a feature or a bug?

i need this function badly...
