Http Get creates the file even if the request failed with error 500

The file is create on Line 215 -
FileOutputStream fos = new FileOutputStream(dest);

However there is cleanup code on line 239-
if (!finished) {
  dest.delete();
}

My understanding is that the file will always be deleted if it hasn't been 
fully downloaded. Is the current code insufficent?
