I think this may be the correct behaviour -

If I do (from the command line)
ss get $/Project -R

and one of the subdirectories contains a file that is not read-only, it does 
indeed report that a writable copy exists and continues.

However, it also does not overwrite the file, and sets the errorlevel to 100. 
Since the file has not been overwritten, the get (getlatest) has not completed 
successfully - your directory does not contain the 'latest' version of the code
as you would expect - thus I'm not sure that this is a bug.

One workaround if you need to do this is to do a checkin immediately beforehand.
