err ... check out all the jakarta build.xmls ... seems like a lot of people 
expect it only to include files.

Umm ... well considering the use of the fileset is the same use that ant's 
own build.xml uses it and many tasks are hardcoded to use it ....

We are not going to break backwards compatability on a whim - doesn't work 
that way.
